PIERRE FABRE MEDICAMENT S.A. (French company) against the Greek company LAVIPHARM S.A.
The Greek company LAVIPHARM S.A. filed in 2002 the Greek trademark application NICODISC No. 165741 for goods in class 5. Our client, the well-known French company PIERRE FABRE MEDICAMENT S.A., had already been the owner of the international trademark application NICODISK No. 803234, registered for pharmaceutical products and dietetic substances for medical use, all these goods for smoking cessation (class 5). Considering that the Greek trademark application NICODISC constituted an infringement against our client’s trademark right, we filed an opposition against the pre-mentioned application, which was approved through decision No. 5098/2011 of the Administrative Trademark Committee.
